These Terms of Service ("Terms") govern your use of tryoffshift.com (the "Site") and your purchase of any product from OffShift, doing business as OffShift ("OffShift", "we", "us"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, Shipping Policy, Subscription Terms, and SMS Terms. If you don't agree, please don't use the Site.

1. Eligibility and age

You must be at least 18 years old to use the Site, purchase our products, or subscribe to our messages. OffShift products are intended for adults only. By ordering, you represent that you are 18 or older and legally able to enter into this agreement.

2. Dietary supplement disclaimer (please read)

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
OffShift is a dietary supplement (magnesium glycinate). It is not a drug, sleep medication, or a treatment for insomnia, shift work sleep disorder, or any other medical condition. Nothing on the Site, in our emails, texts, ads, the Shift Sleep Protocol guide, or in any customer review is medical advice.
Consult your physician or another qualified healthcare provider before using OffShift if you are pregnant, nursing, trying to conceive, have a medical condition (including kidney disease or heart conditions), or take any medication, including but not limited to antibiotics, bisphosphonates, diuretics, or medications for blood pressure or heart rhythm. Magnesium supplements can interact with some medications.
Do not exceed the serving size on the label. Discontinue use and consult a healthcare provider if you experience any adverse reaction. Keep out of reach of children.
Individual results vary. Customer reviews and testimonials reflect individual experiences and are not a guarantee of any result. Persistent difficulty sleeping can be a symptom of a medical condition; talk to a doctor.
The Shift Sleep Protocol guide is general wellness information about light, caffeine, and routine. It is not a substitute for professional medical advice, and it is not intended for use in making decisions about fitness for safety-sensitive work. You are responsible for your own alertness on the job and on the road.
OffShift has not been tested for banned substances in competitive sport unless stated on the label.

3. Products, pricing, and availability

Product descriptions, images, and the Supplement Facts shown on the Site are provided in good faith; the label on the bottle you receive is the authoritative source for ingredients, amounts, and directions. If the two ever differ, the label controls.
Prices are in US dollars and exclude applicable sales tax, which is calculated at checkout. We may change prices at any time; the price shown at checkout is the price you pay for that order (subscription pricing is governed by the Subscription Terms).
We may limit quantities, refuse or cancel any order (including where we suspect fraud, resale, or abuse of the 60-Night Shift Guarantee), or discontinue a product. If we cancel an order after payment, we refund it in full.
Promotional codes are for the stated use only, can't be combined unless we say so, and have no cash value.

4. Orders and payment

By placing an order you authorise us (via our payment processor) to charge your payment method for the total shown at checkout. You confirm the payment method is yours. Your order is accepted when we send a shipping confirmation. Title and risk of loss pass to you when the carrier accepts the package, except that we handle lost and damaged packages as described in the Shipping Policy.

5. Guarantee, refunds, shipping, subscriptions

The 60-Night Shift Guarantee and all refund terms are set out in the Refund Policy. Shipping terms are in the Shipping Policy. Recurring orders are governed by the Subscription Terms. Those pages are part of these Terms.

6. Reviews, testimonials, and user content

If you submit a review, reply to our emails, tag us, or otherwise send us content:

You confirm it's your honest opinion based on your own use of the product, and that you'll disclose any material connection (free product, payment, employment) if you have one.
You grant OffShift a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit for length, and display that content (with your first name, role, and shift type if you've told us) on the Site, in emails, and in advertising. We will only publish quotes from private replies with your explicit permission; public reviews you leave through our review tool may be displayed as reviews.
You can ask us to remove your content at any time by emailing support@tryoffshift.com.
Don't post anything unlawful, defamatory, infringing, or that contains someone else's personal information. We may remove content at our discretion. We don't edit reviews to change their meaning or suppress negative reviews.

7. Intellectual property

The Site, the OffShift name and logo, the Shift Sleep Protocol guide, and all copy, images, and design are owned by OffShift or licensed to us and protected by copyright and trademark law. You may use the Shift Sleep Protocol for your personal use. You may not copy, resell, or redistribute it, or use our marks without written permission.

8. Resale

Our products are sold for personal use only. Purchasing for resale, or reselling on third-party marketplaces, is prohibited without our written consent.

9. Accuracy of information

We try to keep the Site accurate but don't warrant that descriptions, pricing, or other content are error-free. We may correct errors and update information at any time without notice, including after you've placed an order (in which case we'll contact you before shipping).

10. Third-party links and tools

The Site may link to or use third-party tools (payment, reviews, tracking, analytics). We're not responsible for third-party sites or services, and your use of them is subject to their terms.

11. Disclaimer of warranties

Except as expressly stated in these Terms (including the 60-Night Shift Guarantee), the Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted or error-free, or that the product will produce any particular result for you.

12. Limitation of liability

To the fullest extent permitted by law, OffShift, its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states don't allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless OffShift and its owners, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law, or your misuse of the Site or products.

14. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.

Any dispute will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.

Nothing in this section removes any right you have under the consumer-protection laws of your own state or country where those laws apply to you regardless of this agreement.

Before any of that, please email us. Almost everything is fixable with one message.

15. Changes to these Terms

We may update these Terms at any time by posting the revised version with a new effective date. Continued use of the Site after changes means you accept them.

16. Severability, waiver, entire agreement

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site and products.
